Trade Secrets Damages in the Medical Device Industry

In this case, Cirque Analytics was retained on behalf of Defendant Balt USA to address damages related to alleged misappropriation of trade secrets. At issue were claims that former employees had been involved in the design, development, and sales of neuroendovascular medical devices and had misappropriated confidential or proprietary information and used it to design competing products for a competitor in the marketplace.

Dr. Russell Mangum provided damages testimony on behalf of defendant Balt and in rebuttal to plaintiff’s damages expert. Dr. Mangum was supported in his analysis by Vice President D. Scott Bosworth and Erick Delgado, who managed the case. The team reviewed scores of documents and deposition testimony, interviewed key personnel, and worked with a technical expert to model development timelines. Dr. Mangum also addressed the issue of cost avoidance in his testimony.

Following deposition testimony and before trial, the parties entered into a confidential settlement agreement.
