Cirque Analytics Senior Vice President Dr. Chen Song and Vice President Dr. Eric Matolo were retained as testifying experts to evaluate and rebut the conclusions and opinions put forth by plaintiff’s damages expert. Dr. Song and Dr. Matolo investigated categories of driver compensation and business operations information for drivers. They evaluated the scientific validity of Plaintiff’s expert’s sampling and damages extrapolation methods. Additionally, they applied federal hours of service regulations to derive reasonable estimates on driving hours from the driver log and trip databases. They offered rebuttal damages calculations under different scenarios of statute of limitation periods.
